IACHR TAKES CASES TO THE INTER-AMERICAN COURT

 

Washington, D.C., June 25, 2009 — The Inter-American Commission on Human Rights (IACHR) filed two applications with the Inter-American Court of Human Rights in May, related to Mexico and Bolivia.

 

On May 7, 2009, the IACHR filed an application in Case No. 12.580, Inés Fernández Ortega, Mexico. The case has to do with the rape and torture on March 22, 2002, of Inés Fernández Ortega, a Me’phaa indigenous woman, by agents of the Mexican Army, in the Community Barranca Tecuani, Municipio Ayutla de Los Libres, State of Guerrero; the lack of due diligence in the investigation and the lack of punishment of those responsible; the lack of adequate reparations to the victim and her relatives; the use of the military jurisdiction for the investigation and trial of violations of human rights; and the difficulties faced by indigenous persons, especially women, in terms of access to justice.

 

On May 12, 2009, the IACHR filed an application in Case No. 12.529, Rainer Ibsen Cárdenas and José Luís Ibsen Peña, Bolivia. The case has to do with the forced disappearance of Rainer Ibsen and his father José Luís Ibsen, in 1971 and 1973 respectively, during the military dictatorship led by Hugo Banzer Suárez; the lack of due diligence in the investigation and the lack of punishment of those responsible; the fact that the whereabouts of one of the victims has not been established, and the lack of adequate reparations to the relatives.

 

A principal, autonomous body of the Organization of American States (OAS), the IACHR derives its mandate from the OAS Charter and the American Convention on Human Rights. The Inter-American Commission has the mandate to promote respect for human rights in the region and acts as a consultative body to the OAS in this matter. The Commission is composed of seven independent members who act in a personal capacity, without representing a particular country, and who are elected by the OAS General Assembly.
