IACHR EXPRESSES SATISFACTION FOR REPEAL OF PERU’S DECREE 1097
Washington, D.C., September 17, 2010 – The Inter-American Commission on Human Rights (IACHR) expresses its satisfaction for the repeal of Peru’s Decree 1097.
According to the information received, the decree was repealed by Peru’s Congress on September 14, 2010, by 90-1 votes, and the Executive branch made it oficial on September 15, 2010. The IACHR had expressed its concern over the adoption of this decree, regarding the possibility that some of its provisions could lead to impunity in hundreds of cases involving serious human rights violations that occurred during the armed conflict that Peru experienced in the 1980s and 1990s.
The Inter-American Commission trusts that the repeal of this decree will allow to continue to advance the trials for serious violations on human rights perpetrated in the past, in order to punish its material and intellectual authors. Avoiding impunity in these serious crimes is esential for Peru’s democracy and rule of law.
A principal, autonomous body of the Organization of American States (OAS), the IACHR derives its mandate from the OAS Charter and the American Convention on Human Rights. The Inter-American Commission has a mandate to promote respect for human rights in the region and acts as a consultative body to the OAS in this matter. The Commission is composed of seven independent members who are elected in a personal capacity by the OAS General Assembly and who do not represent their countries of origin or residence.
