IACHR TAKES CASE AGAINST GUATEMALA TO THE INTER-AMERICAN COURT

 

Washington, D.C., April 22, 2009 — The Inter-American Commission on Human Rights (IACHR) filed an application with the Inter-American Court of Human Rights against Guatemala on April 17, 2009, in Case No. 12.599, Florencio Chitay Nech et al.

 

The case has to do with the forced disappearance of the maya kaqchikel indigenous political leader Florencio Chitay, which began on April 1, 1981 in the City of Guatemala, with the subsequent lack of due diligence in the investigation of the facts, and with the denial of justice to the detriment of the victim’s relatives .

 

The case was taken to the Inter-American Court because the Commission determined that the State had not complied with the recommendations contained in the report on the merits approved by the IACHR in accordance with Article 50 of the American Convention on Human Rights. In the report, the Commission concluded that the State of Guatemala is responsible for violating the rights protected by the American Convention on Human Rights and by the Inter-American Convention on Forced Disappearance of Persons, to the detriment of Florencio Chitay Nech and his relatives.

 

A principal, autonomous body of the Organization of American States (OAS), the IACHR derives its mandate from the OAS Charter and the American Convention on Human Rights. The Inter-American Commission has the mandate to promote respect for human rights in the region and acts as a consultative body to the OAS in this matter. The Commission is composed of seven independent members who act in a personal capacity, without representing a particular country, and who are elected by the OAS General Assembly.
